JUNK REMOVAL TERMS AND CONDITIONS These terms are an agreement between DV Demo Co ("we", "us") and the customer placing the order ("you"). By signing them when you book, you agree to them for this job. 1. THE ESTIMATE AND THE FINAL PRICE The price shown at booking is an estimate based on the items and amount you describe. The final price is set when our crew sees the items, using the rates, fees and limits shown at booking or on the order confirmation. The crew will tell you the final price before loading anything. If you do not agree to it, you may decline and we will leave without removing anything; in that case only a trip fee may apply, if one is shown at booking or on the order confirmation. 2. ACCESS Please give our crew a clear, safe path to the items and a place to park the truck nearby, secure any pets, and have someone present or leave clear instructions. If we cannot reach the items because of something within your control, a trip fee may apply as shown at booking or on the order confirmation. 3. ITEMS WE CANNOT TAKE We cannot take hazardous or regulated materials, including hazardous waste, chemicals, solvents, oils and fuels, wet or liquid paint, propane tanks and other pressurized containers, asbestos, medical waste, ammunition and explosives, or anything else banned by federal, state or local rules or by the disposal facility. Some items, such as tires, batteries, mattresses, electronics and appliances that contain refrigerant, may be accepted only where local rules allow and may carry the extra charges shown at booking or on the order confirmation. Our crew may refuse any item it reasonably believes is unsafe or prohibited. 4. WHAT GOES Please point out clearly which items are to be removed, and make sure you have the right to dispose of them. Once items are hauled away we cannot return them. 5. PROTECTING YOUR PROPERTY Our crew takes reasonable care when moving items. Please tell us about fragile floors, fixtures or tight spaces before we start. We are responsible for damage our crew causes through negligence. We are not responsible for conditions that existed before we arrived. 6. PAYMENT AND THE CARD ON FILE Payment is due when the job is done. By placing your order, you authorize us to charge the payment method you provided for the final price you agreed to with the crew and for the other charges these terms describe, at the rates shown at booking or on the order confirmation. We will send you a receipt for each charge that says what it is for. If you think a charge is wrong, contact us and we will review it with you. 7. CANCELLATION AND RESCHEDULING You may cancel or reschedule without charge if you tell us at least 48 hours before the scheduled time. If you cancel with less notice, or after the crew has been sent out, a cancellation or trip fee may apply as shown at booking or on the order confirmation. If we need to reschedule, we will contact you as soon as we can, and you may cancel without charge if the new time does not work for you. 8. WEATHER AND DELAYS Arrival times are estimates. Weather, traffic, disposal facility closures and other events outside our reasonable control can delay us. We will keep you informed and reschedule as soon as we can. 9. RESPONSIBILITY FOR LOSS OR DAMAGE We are responsible for loss or damage caused by our negligence or willful misconduct. You are responsible for loss or damage caused by the condition of your property that you did not tell us about and items you asked us to remove that you did not have the right to dispose of, except to the extent it was caused by our negligence or willful misconduct, and you agree to cover our reasonable costs from claims by others that arise from those causes. To the extent the law allows, neither of us is responsible to the other for indirect or consequential losses, such as lost profits. 10. GOVERNING LAW These terms are governed by the laws of the State of Georgia. Nothing in these terms takes away a right you have under consumer protection law that cannot be waived. 11. The terms that apply to your job are the ones you signed when you placed your order, unless you agree to newer terms. — Late payment fees (from your company settings) — Monthly administrative fee: $25.00 is added each month once a balance is more than 30 days past due, on balances of $10.00 or more. Finance charge: 1.5% of the past-due balance is added each month once a balance is more than 30 days past due, on balances of $10.00 or more. It is simple, never compounded, and never charged on earlier fees. Returned-payment fee: $35.00 is added when a check or bank payment is returned unpaid. — End of late payment fees — Disposal: 1 ton included in the price. Each ton over that is $65.00, billed after the load is weighed at the dump.
